They cancel and replace the previous General Terms and Conditions of Sale.
GENERAL TERMS AND CONDITIONS OF SALE LES POULETTES

  1. General

These General Terms and Conditions of Sale ("GTC") apply to sales made by LES POULETTES ("the Seller") via its e-commerce site, accessible at any time from the website www.lespoulettes.com, to private individuals ("the Customer"). They apply automatically to the sale of all products available on the e-commerce site.

The site is operated by LES POULETTES, a simplified joint stock company with a capital of €50,000, located at 43 rue Raffet, 75016 PARIS.

  1. Orders

Orders are placed online via the LES POULETTES website (hereinafter "the Website"). The order is deemed to be final and complete after acceptance of the GTC and payment, subject to the right of withdrawal provided for in Article 5 of these GTC.

Online orders for products will be followed by an email confirmation and summary of the order, it being specified that the acknowledgment of receipt of the order does not in any way constitute confirmation of payment for the order.

Orders are placed exclusively in French.

Products can be ordered while stocks last. Information on the availability or unavailability of Products is provided to the Customer before the order is placed and the Price is paid.

The Customer certifies the accuracy of all information provided when placing the order. LES POULETTES reserves the right to cancel the order in the event of force majeure, fraud, product unavailability, or incorrect information provided by the Customer when placing the order.

The maximum amount of an order placed by a customer (same name, same address) may not exceed €200 including all taxes (excluding delivery costs). Similarly, in 7 days, a customer may not place more than 7 orders, the maximum cumulative amount of which may not exceed €1,400 including all taxes (excluding delivery costs). Beyond these amounts, LES POULETTES reserves the right to refuse the sale, in accordance with Article L121-11 of the French Consumer Code.

In the event of cancellation, LES POULETTES undertakes to refund the price of the Products ordered as soon as possible.

  1. Prices

The Products are sold at the Prices indicated by LES POULETTES on the Website on the day of the order.

Prices may be modified by LES POULETTES at any time. However, LES POULETTES undertakes to invoice the products at the prices indicated when the order is placed.

Prices are quoted in euros and calculated excluding tax. Consequently, they will be increased by the VAT rate and transport costs applicable on the day of the order.

Shipping and delivery costs are the responsibility of the Customer. Shipping and delivery costs are indicated on the Website before the order is placed and the Price is paid.

  1. Payment

The Price is payable by credit card (Bleue, Visa, Mastercard), PayPal account, or any other payment method provided on the Website by LES POULETTES.

Unless otherwise expressly provided, LES POULETTES will only deliver the order once the full Price has been paid.

LES POULETTES reserves the right to suspend/refuse any order processing and delivery in the event of non-payment, refusal of credit card payment authorization, or if a buyer has not paid for all or part of a previous order or is involved in a payment dispute.

In the event of late payment, late payment penalties corresponding to three times the legal interest rate shall be automatically payable without the need for a reminder. These penalties shall run from the day following the payment date shown on the invoice.

Pursuant to Articles L.441-3 and L.441-6 of the French Commercial Code, any debtor paying an invoice after its due date shall pay, upon notification by the seller or an authorized third party, a lump sum compensation fee of €40 to cover collection costs.

If, within fifteen days of the implementation of the "Late Payment" action, the Customer has not paid the outstanding amounts, the sale will be terminated automatically and may give rise to the allocation of damages to the Seller.

  1. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products ordered to exercise their legal right of withdrawal without having to justify their decision. When the fourteen (14) day period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

The packaging may only be opened to the extent necessary to assess the nature, characteristics, and functioning of the products.

If the conditions applicable to the exercise of the right of withdrawal are not fully met, the Seller reserves the right:

     Refuse the return and refund; and/or

     To reduce the amount of the refund if the products have suffered a loss in value due to handling other than that necessary to establish the nature, characteristics, and functioning of the products, in particular damaged, missing, or used products.

The Customer exercises their right of withdrawal by returning the withdrawal form attached to the GTC by email to bonjour@lespoulettes-paris.com, along with the Products in perfect condition for resale.

Products subject to the right of withdrawal will be refunded by LES POULETTES to the account using the same payment method used when purchasing the order, within fourteen (14) days from the date on which the company was informed of the decision to withdraw.

The Seller has the right to defer the refund until the product has been recovered, or until the Buyer has provided proof of shipment of the product.

Return shipping costs are the responsibility of LES POULETTES.

  1. Delivery

Products are delivered by LES POULETTES to the address provided by the Customer when placing the order via La Poste (tracked letter or Colissimo depending on the size of the order).

LES POULETTES undertakes to ship the order within an average of five (5) business days, depending on the delivery method chosen by the buyer.

Delivery times of seven (7) business days are inherent to the mode of

and are indicative. Consequently, LES POULETTES shall not be liable for any compensation in the event of delays.

LES POULETTES cannot be held responsible for any delay in delivery caused by the carrier.

Any case of force majeure suspends the execution of the order for its duration and extends the delivery time accordingly.

In the event of a delay in delivery, the Customer must report this delay as soon as possible to LES POULETTES by email to bonjour@lespoulettes-paris.com

  1. Guarantee

The Products are certified by Ecocert and comply with French and European cosmetics regulations (Regulation (EU) 2017/1413 European Commission of August 3, 2017).

The Products are covered by the legal guarantee of conformity as provided for in Article L217-4 et seq. of the French Consumer Code and the guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

The resale or distribution of purchased products is strictly prohibited.

  1. Complaints

In the event of non-conformity or apparent defect in a Product upon delivery or a missing Product, the Customer must inform LES POULETTES within thirty (30) days by registered letter with acknowledgment of receipt sent to the registered office at 43, rue Raffet, 75016 Paris.

LES POULETTES may, as far as possible, replace or refund the Product, without this possibility constituting an obligation of result.

The Customer must return the product in its original packaging to the same address.

  1. Intellectual property

The LES POULETTES brand, as well as all logos, designs, and illustrations appearing on the Product packaging or on the Website, are and remain the exclusive property of LES POULETTES or the holder of the relevant intellectual property rights.

Any total or partial reproduction, modification or use of the brand, illustrations, images and logos or the content of the Website for any reason and on any medium whatsoever, without the agreement of LES POULETTES or the holder of the intellectual property rights concerned, is strictly prohibited. The same applies to all copyrights, designs, and patents appearing and/or used on the Website and on the Products.

  1. "Data Protection"

LES POULETTES is responsible for collecting the Customer's personal data and, where applicable, that of the recipient of the order.

The information collected by the company during any order placed by the Buyer is necessary for the processing of orders.

The Customer is informed that this automated processing of information, in particular the management of users' email addresses, has been declared to the CNIL.
In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, the buyer has the right to access, rectify, delete, and object to the use of their personal data. The buyer may exercise this right by writing by email to bonjour@lespoulettes-paris.com or by post to Les Poulettes, 43, rue Raffet 75016 Paris, indicating their surname, first name, and address, as well as the subject of the request.

For any information concerning data processing and to find out about their rights, the Buyer may consult the Website's privacy and data protection policy.

     11. Mediation

In accordance with Order No. 2015-1033 of August 20, 2015, and Implementing Decree No. 2015-1382 of October 30, 2015, any consumer dispute or litigation, subject to Article L.152-2 of the Consumer Code, may be settled amicably through mediation at the CMAP – Centre de Médiation et d’Arbitrage de Paris (Paris Mediation and Arbitration Center).
 
Before referring the matter to the CMAP, the consumer must have already contacted Les Poulettes Customer Service (bonjour@lespoulettes-paris.com) and not have received a response or satisfactory resolution to their complaint.
 
To submit your dispute to the mediator, you can:
- fill out the form on the CMAP website: www.cmap.fr, under the "consumer" tab;
- send your request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr
 
Regardless of the method used to contact the CMAP, your request must contain the following information in order to be processed quickly: Your postal address, email address, and telephone number, as well as the full name and address of your company or the establishment concerned, a brief summary of the facts, and proof of previous steps taken with our company or the establishment concerned.

     12. Applicable law and jurisdiction

These GTC are subject to French law. In the event of a dispute and in the absence of conciliation, the interpretation of the GTC, the execution or termination of the GTC shall be the exclusive jurisdiction of the courts of Paris.

WITHDRAWAL FORM

Conditions :

  • Complete and sign this form or copy it onto a blank sheet of paper.
  • Send it by registered mail with acknowledgment of receipt.
  • Use the following address: LES POULETTES SAS, 43 rue Raffet 75016 Paris
  • Send it no later than the fourteenth (14th) day from the date of delivery of the order or, if this period normally expires on a Saturday, Sunday, or public holiday, the next working day.
